Terms of Service

These Terms of Service (“Terms”) govern your use of the Model Box website and application (“Service”), operated by Chunk Creations Sp. z o.o. (“we,” “us,” or “our”). By using the Service, you agree to these Terms in full. If you do not agree with any part of these Terms, please do not use the Service.

1. Description of the Service

Model Box is a web application for managing miniature painting catalogues. The Service allows you to, among other things:

  • Browse paint catalogues from various manufacturers
  • Search for color matches and equivalents across brands
  • Manage your personal paint collection
  • Create shopping lists and color palettes

The Service is available free of charge. Some features may require creating an account.

2. Registration and User Account

To access the full functionality of the Service, you may need to create an account. By registering, you agree to:

  • Provide accurate and up-to-date information
  • Keep your account access secure
  • Promptly notify us of any unauthorized access to your account

You are responsible for all activities that occur under your account. Each account may only be used by a single individual.

3. Acceptable Use

When using the Service, you agree to:

  • Comply with all applicable laws and regulations
  • Not infringe on the intellectual property rights of third parties
  • Not use the Service in any way that could damage, overload, or impair its operation
  • Not attempt to gain unauthorized access to systems or data

Paint names, brands, and manufacturer logos belong to their respective owners and are used for informational purposes only.

You may not copy, modify, distribute, or commercially exploit any content from the Service without our prior written consent.

5. User Content

By using the Service, you may create and store certain content (e.g., paint lists, color palettes). You retain rights to your content, but grant us a non-exclusive, perpetual license to store and process it for the purpose of providing the Service.

We are not responsible for content created by users.

6. Service Availability

We strive to maintain uninterrupted availability of the Service, but we do not guarantee continuous or uninterrupted access. The Service may be temporarily unavailable due to:

  • Maintenance or updates
  • Technical failures
  • Circumstances beyond our control

We are not liable for any losses resulting from the unavailability of the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service
  • We do not guarantee the accuracy, completeness, or currency of paint color information and equivalents — they are provided for reference purposes only

These limitations of liability do not apply to the extent that they would be inconsistent with applicable law, including consumer protection regulations.

8. Account Deletion

You may request the deletion of your account at any time by contacting us using the contact information provided below. Upon receiving your request, we will:

  • Deactivate your account
  • Delete your personal data from our active databases
  • Retain only data required by applicable law (e.g., for tax or accounting purposes)

Account deletion is irreversible and will result in the loss of access to all data stored in your account.

9. Service Termination

We reserve the right to:

  • Suspend or discontinue the Service at any time, with appropriate notice
  • Modify the scope and functionality of the Service

In the event of a planned discontinuation of the Service, we will notify users at least 30 days in advance, allowing for data export.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised modification date. We will notify users of material changes through the Service or via email.

Continued use of the Service after changes are made constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be resolved by the competent courts in the jurisdiction of Chunk Creations Sp. z o.o., subject to mandatory consumer protection provisions that may entitle consumers to bring disputes before the courts of their place of residence.
